This Electronic Signature and Electronic Records Consent ("E-Sign Consent") applies to any person or entity using HEAT Freight's website, forms, portals, upload tools, e-signature tools, and related electronic systems to submit information, sign documents, request services, accept terms, or conduct business with Heavy Equipment Auction Transport LLC d/b/a HEAT Freight ("HEAT Freight").

By checking a box, typing a name, drawing a signature, clicking "submit," uploading documents, or otherwise using HEAT Freight's electronic contracting or submission process, you agree to this E-Sign Consent.

1. Consent to Electronic Transactions

You consent to conduct business with HEAT Freight electronically.

You agree that agreements, notices, disclosures, invoices, rate confirmations, setup documents, credit documents, carrier documents, customer documents, claims communications, payment instructions, and other records may be provided, signed, stored, and enforced in electronic form.

2. Electronic Signatures

You agree that any of the following may constitute your electronic signature or the electronic signature of the entity you represent, where applicable:

  • checking an acceptance box,
  • typing your name,
  • drawing or affixing a signature through an e-sign platform,
  • clicking a button labeled "submit," "sign," "accept," "approve," or similar wording,
  • replying by email in a manner indicating approval or assent,
  • uploading a signed or unsigned document as part of an electronic workflow, or
  • using any authenticated portal or workflow that reasonably identifies you or the entity you represent.

You agree that an electronic signature may have the same force and effect as a handwritten signature.

3. Electronic Delivery of Records

You agree that HEAT Freight may provide records electronically, including by:

  • website posting,
  • portal display,
  • email,
  • downloadable PDF,
  • e-sign platform,
  • upload link,
  • text message link, or
  • other electronic method reasonably used by HEAT Freight.

4. Paper Copies

You may request a paper copy of an electronically delivered record by contacting HEAT Freight.

HEAT Freight may charge a reasonable administrative fee for paper copies to the extent permitted by law.

5. Withdrawal of Consent

You may withdraw your consent to transact electronically by written notice to HEAT Freight.

Withdrawal of consent does not affect the validity of records or agreements already signed or delivered electronically before withdrawal becomes effective.

If you withdraw consent, HEAT Freight may decline to continue doing business through electronic-only systems and may suspend access to forms, portals, e-sign workflows, or account features that depend on electronic delivery.

6. Hardware and Software Requirements

To use HEAT Freight's electronic systems, you should have:

  • internet access,
  • a current web browser,
  • a valid email address,
  • the ability to open PDF or similar electronic files,
  • a device capable of completing online forms and signatures, and
  • the ability to retain or print records if desired.

7. Record Retention

You are responsible for saving, downloading, printing, or otherwise retaining copies of records you wish to keep.

HEAT Freight may retain electronic records, audit logs, submission logs, IP logs, timestamp data, and related evidence of electronic assent or delivery.

8. Authority

If you act on behalf of a company or other entity, you represent that you have authority to bind that entity to the electronic records, signatures, agreements, and submissions you make.

9. Contact Information

You are responsible for keeping your email address, phone number, and other contact information current so HEAT Freight can deliver records and notices electronically.
